Article 147 of the Belgian constitution

​Under Article 608 of the Judicial Code, the Court of Cassation reviews decisions made in final instance that are submitted to it for breach of the law or for violation of either substantial or procedural formalities under penalty of nullity. While lower courts are tasked with applying the rule of law to the facts presented by the parties, the Court of Cassation examines the appealed decision made in final instance: Is it properly reasoned? Is it in accordance with the law? Does it correctly apply and interpret the rule of law? Does it respect the scope of an act that was subject to judicial review?

​Ms. Samia Zahmidi has taken the oath of office in her capacity as Chief Service Secretary at the Public Prosecutor’s Office attached to the Court of Cassation. We extend to her our sincere congratulations on this distinguished appointment.

​The Court of Cassation had the pleasure of welcoming a delegation of Ukrainian judges visiting Brussels as part of an institutional meeting.
On this occasion, the First President and the Prosecutor General presented the role of the Court of Cassation and the challenges facing the Belgian judiciary.

​The Court of Cassation welcomed Mr Marko Bošnjak, President of the European Court of Human Rights (ECtHR), as part of his official visit to Belgium. He was accompanied by Mr Frédéric Krenc, Belgian Judge, and Mr Johan Callewaert, Deputy Registrar of the Grand Chamber. This meeting provided an opportunity for an institutional exchange on the Convention system in general, as well as on various topics related to human rights.
